Poland vs the EU : Situation leading to POLEXIT ?

ree

Brexit is now an event that has been brought to everyone's attention since it occurred in January of 2020, but now, nearly 2 years away from that, another country is now on the verge of leaving the European Union ; Poland. Contrarily to Brexit, Poland leaving the EU would simply be a legal pull-out, but it would still damage the strength the unification of European countries, that has been going on since 1993.

As the Polish constitutional tribunal prioritized Polish constitutional court law over European law, incoherence between both systems made the disagreement that Poland has with some of the laws that countries in the European Union must follow a real issue. By not binding to these regulations, Poland is weakening a key legal pillar of the UE ; the Rule of Law, the principle that no individual, group, or even state, is above the law, protecting people from dictatorship, as no government can create a law that is not applying known moral and legal principles. As a reply to these actions, the European commission has threatened Poland to use its powers against the country, but the prime minster of Poland, Mateusz Morawiecki, stating that Warsaw, capital of Poland, considers the Rule of Law as important as the 26 other member countries do, not just for the matters of the treaties, but also for its principle that is strongly embodied in the Polish constitution. However, he adds that the Rule of Law is being used as an excuse to request actions of the member states that were not implied in the treaties, protesting the supremacy of the EU alliance.

For now, the only concrete action that the EU has done, is not giving Poland its 65 billion dollars share of the 865 billion dollars of post-Covid 'stimulus package', which remains waiting for it. The Eu has stated that 'those who violate the Rule of Law should not receive EU funds'. There is a mechanism in place for member states violating EU law, but the Commission is failing to use it, staying in what can be considered as inaction, making the President of the European Parliament demand a lawsuit against the Commission to ensure that rules are properly enforced.

The denunciations of Poland are now inspiring other countries to follow the movement, such as Hungary, which have been legally fighting the Union for several months. As a result of that, not only the conflict of Poland against the EU might end in Poland pulling out of the European Union, but mutual trust between member states has been weakened, and other countries might follow Poland, which might strongly affect and diminish the power of the EU.
